The ARE Skip Bins Website
​
The website invites customers to supply certain information regarding their service requirements. On the basis of that information, ARE Skip Bins will provide a quote for services best suited to the customer’s requirements. The customer will then be invited to submit a purchase order.
Skip Bin Orders
​
Submitting a purchase order to the website constitutes an offer to enter into a contract for the provision of refuse bin services with ARE Skip Bins. On receipt of confirmation of that order, customers will be bound by a contract to purchase the services requested in the purchase order, subject to the customer’s rights to cancel or vary the order set out in these terms and conditions. The standard hire period for skip bin is 7 days, unless otherwise specified.
Trading Terms

ARE Skip Bins will supply services to customers on these terms only (as may be amended from time to time). The only circumstance where any variation to these terms will apply is where ARE Skip Bins has expressly agreed in writing to that variation. If there is any conflict with other terms of trade, these terms will take priority over any other terms of trade.

Pricing Policy
​
The price of the goods or services is that stated on the website at the time of acceptance of your purchase order, unless otherwise expressly agreed in writing by ARE Skip Bins. The price include goods and services tax (“GST”). All prices are stated in Australian dollars.
All prices include the cost of delivery and removal of bins. Prices quoted are based on the information which customers submit to the website. ARE Skip Bins reserves the right to vary prices if that information is incorrect.

Booking Notice
​
Customers must make payment for their order upon submission of that order by direct deposit, eftpos or credit card payment directly to ARE Skip Bins.

Bin Filling Limits
​
Any refuse bin that is filled above the top rail and is overloaded will incur a futile callout charge and may be liable for additional weight and bin hire charges. It will be at the customers cost to unload the refuse bin to a safe working level. Any refuse bin exceeding the maximum weight allowed will be charged as a Heavy Waste Bin.

Additional Charges
​
Additional charges will apply for futile callout charges, non-standard and/or prohibited waste types.
Futile callout charge – $150
Car tyres – $80
4WD Tyres – $100
Truck Tyres – $150
Fire Extinguishers – $100
Gas Cylinders – $100
Mattresses – $100 each
Bin hire extension (Up to 7 days) – $100

Skip Bin Delivery
​
ARE Skip Bins will deliver refuse bins on the agreed delivery date. However, delivery times can and may vary. To obtain an approximate delivery time, customers can contact the ARE Skip Bins office via phone or email. Late delivery does not entitle customers to cancel any order or part order. Refuse bins are to be located within a customers’ property boundary. Requests to position a refuse bin on public land or nature strips will be at the customers liability. Council issued permits are the responsibility of the customer or contractor to obtain. Refer to your local Council for specific advice. ARE Skip Bins will not be held liable for any fines due to improper bin placement.
Whilst the ARE Skip Bins driver take due care throughout the delivery process, ARE Skip Bins cannot be responsible for the structural integrity of driveways or grounds (due to sub soil conditions, wet weather or any other contributing factors). No Liability is accepted during the delivery and collection of bins. Any occurrence of damage caused above or below ground, whether it be on a customer’s property or elsewhere, will be at the customer’s’ expense.

Refunds
​
ARE Skip Bins will provide a full refund of fees paid in respect of:
(a) any ordered services not provided; or
(b) any services provided not being substantially the same as the services requested in the purchase order provided the customer notifies ARE Skip Bins of the request for refund within 5 working days of the scheduled delivery date for the service.

Usage of the ARE Skip Bins Skip Bins
​
While refuse bins are in the customer’s possession, the customer is forbidden to:
(a) light fires in the bin; or
(b) place or allow any liquids or any explosive, toxic, dangerous, hazardous or noxious materials (including but not limited to polystyrene including polystyrene bonded to concrete, cold room panels, solar panels, asbestos, acids, solvents, minerals, gas bottles, fire extinguishers, tyres, greases, silica dust, food waste, wet paint or liquid concrete) into the bins. If found, we reserve the right to refuse the load and/or pass on the extra costs to the customer to dispose of the waste lawfully; or
(c) fill any bin higher than the top of its sides, in such a manner that spillage of material from the refuse bin can occur, either while stationary or in transit; or
(d) move any bin without ARE Skip Bins consent.

Allowable Weights
​
ARE Skip Bins provides allowable weight limits of bins during the online booking process. Allowable weights are displayed once a selection of the waste type and bin size has been chosen by the customer. Any refuse bin exceeding the maximum weight allowed will be charged as a Heavy Waste Bin. ARE Skip Bins maintains the right to refuse any and all refuse bin collections in compliance to all Government transport, Workplace Health and Safety and Chain of Responsibility regulations. It will be at the customers cost to unload the refuse bin to a safe working load and is liable for additional bin hire charges if the refuse bin cannot be loaded promptly.

Risk
​
Customers will be liable for any damage to refuse bins which occurs while the customer has possession of the bin, subject to fair wear and tear.

Cancellation of Orders
​
Customers are entitled to cancel or vary an order provided that ARE Skip Bins receives notice of the variation or cancellation no less than two (2) working days before the delivery date requested in the order. Any other variation to the order will be granted at ARE Skip Bins sole discretion and subject to payment of reasonable costs.
In the event an order is cancelled by ARE Skip Bins, the customer will receive a full refund of all monies paid in advance for the cancelled order.

Liability Limitation
​
The liability of ARE Skip Bins for any claim, damages, loss or expense related to the supply of services is limited to the cost paid by the customer for those services, except where statute expressly requires otherwise. To the fullest extent permitted by law, ARE Skip Bins will not be liable in any event whether in tort (including negligence), contract or otherwise for any loss of profits or any consequential, indirect or special damage, loss or injury of any kind suffered by the customer or any other person.
ARE Skip Bins will not be liable for any failure or delay in complying with any obligation imposed by these terms if the failure or delay arises directly from an any circumstance beyond ARE Skip Bins control, including, without limitation, fire, flood, earthquake, explosion, war, insurrection, sabotage, industrial disputes, transportation, embargo, changes in law, delays or disruption by government or government agencies.

Changes to Terms and Conditions
​
ARE Skip Bins may alter these terms at any time by placing notification that the terms have been revised on the website. By continuing to access the website, the customer agrees to be bound by the amended terms and conditions.

Waiver
​
If at any time ARE Skip Bins does not enforce any of these terms or grant the customer time or other indulgence, ARE Skip Bins will not be construed as having waived that term or its rights to later enforce that or any other term.
​
Severability
​
If any portion of these terms is deemed to be invalid, illegal or unenforceable the remaining provisions shall remain in full force and effect.
​
Governing Law
​
These terms will be governed by Australian law and the customer agrees to submit to the exclusive jurisdiction of the Queensland Courts.

Security
​
This site is protected by a Secure Socket Layer (SSL) of 256-bit encryption. Website payments are made via the Stripe, Inc. platform. Whilst all reasonable endeavours are made to ensure your online activities are secure, ARE Skip Bins does not accept liability for any loss that may be suffered by you in relation to charging on your credit card.
